SwiftFlow Transport

1.Acknowledgement and Acceptance

By reserving transportation with SwiftFlow Transport or boarding a SwiftFlow vehicle, each passenger ("Passenger") acknowledges having read and accepted this waiver. The individual who books the reservation represents that they are authorized to accept it for every member of the party.

This waiver supplements, and does not replace, our Terms of Service.

2.Assumption of Risk

Passenger understands that ground transportation involves inherent risks that cannot be eliminated by reasonable care, and voluntarily assumes those risks.

  • Risks associated with travel on public roadways, including the conduct of other drivers
  • Sudden stops, turns and road conditions while entering, riding in, or exiting the vehicle
  • Slips, trips and falls at curbs, terminals, ports and venues
  • Handling of personal luggage and belongings
  • Delays or route changes caused by traffic, weather or events outside our control

3.Passenger Responsibilities

Passenger agrees to conduct themselves safely and to follow the chauffeur's lawful instructions at all times.

  • Wear a seat belt whenever the vehicle is in motion
  • Remain seated; do not stand, lean out of windows, or open doors while moving
  • Do not smoke, vape, or use illegal substances in the vehicle
  • Consume alcohol only where legally permitted and only if 21 or older
  • Supervise minors at all times and use required child restraints
  • Disclose any medical or mobility condition that may require accommodation

4.Release of Claims

To the fullest extent permitted by Florida law, Passenger releases SwiftFlow Transport, its owners, employees, chauffeurs, affiliate operators and insurers from claims for injury, loss or damage arising out of Passenger's own negligence, intoxication, horseplay, or failure to follow safety instructions or the chauffeur's directions.

This release does not apply to, and Passenger does not waive, claims arising from SwiftFlow's gross negligence or willful misconduct, or any liability that cannot be released under applicable law.

5.Personal Property

Passenger is solely responsible for their belongings. SwiftFlow is not liable for loss, theft or damage to luggage, electronics, or other personal property carried in or left in a vehicle. Recovered items are held for 14 days and returned at the Passenger's expense.

6.Medical Emergencies

In a medical emergency, the chauffeur will contact emergency services and may divert to the nearest appropriate facility. Passenger authorizes such action and is responsible for any resulting medical costs. Passenger should carry required medications and disclose relevant conditions before travel.

7.Indemnification

Passenger agrees to indemnify and hold SwiftFlow harmless from claims, damages, cleaning charges, repair costs and legal fees arising from Passenger's violation of this waiver, our Terms of Service, or applicable law, including damage caused to the vehicle by Passenger or their guests.

8.Alcohol and Intoxication

SwiftFlow does not supply alcohol. Where alcohol is legally permitted on board and provided by the Client, the Client is responsible for ensuring no one under 21 consumes it. The chauffeur may refuse boarding or terminate service without refund if a passenger's intoxication creates a safety risk.

9.Minors

A parent or legal guardian booking transportation for a minor accepts this waiver on the minor's behalf and confirms that appropriate child restraints will be used as required by Florida law.

10.Severability and Governing Law

If any provision of this waiver is found unenforceable, the remaining provisions stay in full force. This waiver is governed by the laws of the State of Florida, with venue in Miami-Dade County.
